This website, karenannetham.com, is operated by Karen Anne Tham, trading as Karen Anne Tham Art, at Sylvatica, Hids Copse Road, Oxford, OX2 9JJ, United Kingdom. You can contact me at ktwright29@gmail.com or +44 (0)7780 546 507. I am not VAT registered.
The product description identifies the artwork and what is included. Artwork is usually supplied unframed and unmounted unless stated or separately agreed. Please ask if you need a size or other detail that is not shown. Any framing or mounting service and its cost must be agreed separately. Packaging is selected to suit the work.
Prices are in pounds sterling. UK tracked postage and packing is £20 per order, added at checkout; collection by arrangement is free. I do not add VAT. Overseas enquiries are handled separately, as explained in Delivery and collection.
Images help show the artwork, although screen settings can affect colour appearance. This does not limit your right to receive artwork that matches its description.
Payment is by bank transfer. Use your order number as the transfer reference. The artwork is dispatched after payment has cleared.
Your order is a request to buy the artwork. The automatic order-received email acknowledges your request; it is not acceptance of your order. I check availability and payment, then accept your order by sending the email headed “Order accepted — preparing your artwork”. The contract is formed when that acceptance email is sent. For an overseas order, the delivery arrangements and total will be agreed before you commit to the order.
Please make your bank transfer promptly. If payment remains outstanding, I will contact you before cancelling the order. If I cannot accept your order, I will explain and return any payment received. If there is a pricing or description error, I will contact you to agree how to proceed; I will not substitute another artwork or increase the agreed price without your agreement.
The Delivery & collection page forms part of these terms. Returns, cancellations and commissions are covered in the section below. Your order confirmation will provide the applicable terms in a format you can keep.
Under UK consumer law (the Consumer Contracts Regulations 2013), you have a legal right to cancel an online purchase of an existing, non-personalised artwork without giving a reason, provided you are buying as a consumer.
To exercise this right, you must notify me within 14 calendar days, starting the day after you, or someone you nominate other than the carrier, receives the artwork. If one order arrives in separate deliveries, this period starts the day after the final item or part arrives. You may also exercise this right before delivery.
This statutory change-of-mind right does not apply to bespoke or personalised commissions, as explained below.
Email ktwright29@gmail.com, write to Karen Anne Tham, Sylvatica, Hids Copse Road, Oxford, OX2 9JJ, United Kingdom, or use the optional cancellation form below. A clear statement that you wish to cancel is sufficient; you do not have to use the form. Please include your name, order number and the artwork concerned to help identify the order.
Send the artwork back within 14 days after telling me you are cancelling, to Karen Anne Tham, Sylvatica, Hids Copse Road, Oxford, OX2 9JJ, United Kingdom. Return all parts supplied as part of the artwork and package them securely as described below.
You pay the direct cost of returning artwork when you change your mind. Please arrange a tracked service with insurance or compensation cover for the full price paid for the artwork. Check that the carrier accepts and covers original artwork, including its support or frame, and follow its packing conditions. Keep proof of posting and the cover purchased. These costs are paid to your chosen carrier; they are not a fixed £20 return charge.
Tracked, fully covered postage is recommended to protect the return. Choosing a different service does not by itself remove your statutory cancellation rights. For an artwork that cannot normally be returned by post, I will disclose an estimated return cost before you buy.
Take reasonable care of the artwork and handle it only as needed to inspect it, as you reasonably would in a shop. Use the original protective packaging if available, or equally protective packaging suitable for the work. Artwork does not have to remain unopened to qualify for statutory cancellation.
I may inspect returned artwork and assess its condition against dispatch records. Where the law permits, I may deduct the actual loss in value caused by handling beyond reasonable inspection. For example, damage caused by framing, mounting, alterations, cleaning or other unnecessary handling may reduce the refund. A deduction may be up to the price paid for the artwork if the evidenced loss is that great; it is not an automatic charge. I will explain the reason and basis for any deduction.
Careful unpacking and reasonable inspection alone do not justify a deduction. There is no cancellation or restocking fee.
I will refund the price paid and any standard outward delivery charge. If you chose a more expensive delivery service, the additional upgrade cost is not refundable. For cancellation of a whole order, the current £20 UK delivery charge is refunded. No outward delivery charge applies to a collection order.
Refunds are made without undue delay, using the original payment method unless you expressly agree otherwise, without a refund fee. If the artwork must be returned and I have not offered collection, I may wait for it or evidence of posting. The refund is due within 14 days of receiving the artwork or that evidence, whichever is earlier. In other cases, it is due within 14 days of your cancellation notice.
Contact me if the artwork arrives damaged, is faulty or differs from its description. Your rights are separate from change-of-mind cancellation. You will generally have a 30-day right to reject non-conforming goods, with further remedies potentially available afterwards. I will cover reasonable necessary return costs, including appropriate transit cover, for faulty or misdescribed goods and arrange an appropriate remedy under your statutory rights. Contact me about the return service so that suitable handling can be arranged. A one-off artwork may not have an identical replacement.
Please let me know promptly and include your order details. Photos of the artwork and packaging can help establish what happened. Damage caused by your own misuse or mishandling is not a fault for which I am responsible; this does not remove rights relating to an unrelated original fault. No short photo-reporting deadline removes your statutory rights.
Bespoke commissioned artwork made to your specifications, or clearly personalised for you, is excluded from the statutory change-of-mind cancellation and returns right. This exclusion does not remove your rights if the commission is faulty or not as described.
An existing original is not exempt simply because it is unique, and describing an ordinary sale as a “commission” does not create an exemption. The commission brief, price, payment stages and any separately agreed cancellation terms are recorded before you commit to the commission.
Complete and return this form only if you wish to cancel the contract. You may email it; a clear cancellation message is also sufficient.
